1. Definitions and Interpretation
In these Terms, unless the context requires otherwise:
- "we", "us", "our" means The Jacket Seller Ltd, a company registered in England and Wales under company number 16174052, whose registered office is at 283 New North Road, London, N1 7AA, United Kingdom;
- "you", "your" means the individual or entity accessing the Website or placing an Order;
- "Website" means www.thejacketseller.com and any associated subdomains, mobile applications or storefront integrations we operate;
- "Products" means the leather jackets and related apparel offered for sale on the Website, whether standard, made-to-order or fully customised;
- "Order" means a request to purchase Products submitted by you through the Website's checkout process;
- "Contract" means the legally binding agreement between you and us for the sale and purchase of Products, formed in accordance with clause 8;
- "Consumer" has the meaning given in the Consumer Rights Act 2015, being an individual acting for purposes wholly or mainly outside that individual's trade, business, craft or profession;
- references to "writing" include email;
- headings are for convenience only and do not affect interpretation.

You can contact us using the details above. Any notice you send us by email is treated as received on the day it is sent, provided no delivery failure notification is received by us.
3. These Terms
These Terms govern your use of the Website and any Order you place with us. By using the Website, browsing our Products, creating an account, or placing an Order, you accept these Terms in full. If you do not agree to these Terms, you must not use the Website.
These Terms should be read together with our Return & Refund Policy, Shipping Policy and Privacy Policy, each of which is incorporated into these Terms by reference. Where there is a direct conflict between these Terms and a specific policy on a matter that policy expressly covers, that specific policy will prevail in relation to that matter only.
We may revise these Terms at any time by updating this page. The version in force at the time you place an Order will govern that Order. Material changes affecting an Order already placed but not yet fulfilled will be notified to you by email.
4. Eligibility to Use This Website
You may only use the Website and place an Order if you are at least 18 years old, or you have the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By placing an Order you confirm that this condition is satisfied and that all information you provide is accurate, current and complete.
We reserve the right to refuse service, terminate accounts, or cancel Orders at our discretion where we reasonably suspect a breach of this clause.
5. Account Registration
You may place an Order either by creating an account or as a guest, without registering an account. Where you choose to create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at contact@thejacketseller.com if you suspect unauthorised use of your account.
Regardless of whether an Order is placed with or without an account, these Terms apply in full to that Order.
We reserve the right to suspend or terminate any account, or refuse to process any Order (guest or account-based), that we reasonably believe is fraudulent, abusive, or in breach of these Terms.
6. Product Descriptions and Availability
We make reasonable efforts to ensure that Product descriptions, images, sizing charts and pricing on the Website are accurate. However:
- colours may vary slightly from what is displayed due to screen calibration, lighting and photography conditions;
- because most Products are made-to-order using natural leather, minor variations in grain, texture, shade and stitching between units are normal and do not constitute a defect;
- Product availability is not guaranteed until an Order is accepted in accordance with clause 8;
- we reserve the right to correct any pricing or description errors at any time before an Order is dispatched, and to cancel and refund an affected Order if a material error is identified.
7. Pricing and Taxes
All prices are displayed in the currency shown at checkout and are inclusive of applicable UK VAT unless stated otherwise. For deliveries outside the United Kingdom, you may be responsible for import duties, customs charges and local taxes levied by the destination country. These charges are outside our control and are your responsibility; we recommend checking with your local customs authority before ordering.
We reserve the right to change prices at any time, but changes will not affect Orders already accepted in accordance with clause 8.
8. How Contracts Are Formed (Order Process)
The Order process is as follows:
- You select Products, provide sizing/customisation details, and proceed through checkout. Submitting an Order constitutes an offer to purchase, not acceptance by us.
- You will receive an automated Order confirmation email. This confirms we have received your Order; it is not acceptance of your Order and does not form a Contract.
- A Contract is only formed when we send you a separate email or notification confirming that your Order has been accepted and production/dispatch has commenced ("Acceptance Confirmation").
- We may decline to accept an Order, in whole or in part, at any time before Acceptance Confirmation is sent, including where: the Product is unavailable; there is a pricing or description error; payment is not successfully authorised; we suspect fraud; or the Order does not comply with these Terms. If we decline your Order after payment has been taken, we will refund the payment in full within a reasonable time.
9. Payment
Payment for your Order must be made in full through one of our accepted payment methods at checkout. We use third-party payment processors to handle payment card data; we do not store full payment card details on our own systems. Production of made-to-order Products will not begin until payment has been successfully authorised.
If a payment is declined, reversed, or otherwise fails after Acceptance Confirmation has been sent, we reserve the right to suspend production and pause dispatch until the matter is resolved.
10. Made-to-Order and Custom Size Products
Most Products sold on the Website are manufactured specifically for you after your Order is placed, based on standard or customer-supplied measurements ("Made-to-Order Products"). This has the following legal and practical consequences:
- Made-to-Order Products are manufactured to your specification or clearly personalised. Under Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the standard 14-day statutory right to cancel for change of mind does not apply to goods made to a consumer's specification or clearly personalised.
- Where we send you a size confirmation email after you place your Order, it is your responsibility to review and respond within the timeframe stated in that email. We rely on your confirmed measurements to manufacture your Product.
- Where the delivered Product matches the measurements you confirmed, but does not fit as you expected, your remedy is limited to the options set out in our Return & Refund Policy (which may include an exchange or partial refund, rather than a full refund), because the Product was manufactured correctly to the specification you approved.
- Where the delivered Product does not match the measurements you confirmed, this is treated as a fault on our part and clause 16 (faulty goods) applies.
- This clause does not affect your statutory rights in respect of defective or not-as-described goods under the Consumer Rights Act 2015 (see clause 16), which cannot be excluded.
11. Shipping and Delivery
Estimated delivery times shown on the Website or in Order confirmations are estimates only and are not guaranteed delivery dates, unless we have expressly agreed a specific delivery date with you in writing. Delivery timescales may be affected by production time, courier delays, customs clearance procedures, extreme weather, or other circumstances outside our reasonable control (see clause 27, Force Majeure).

If your Product has not been delivered within 30 days of the date given in your Acceptance Confirmation and this is not due to an event outside our control or your own fault (for example, providing an incorrect delivery address), please contact us and refer to our Return & Refund Policy for your entitlement to a refund.
12. Risk and Title
Risk in the Products (responsibility for loss or damage) passes to you upon delivery to the address provided in your Order. Title (ownership) in the Products passes to you once we have received payment in full.
13. Your Right to Cancel (Consumer Contracts Regulations 2013)
Where a Product you order is not made-to-order or personalised (i.e. a standard stock item, if offered), you have the right to cancel your Contract within 14 days of receiving the Product without giving a reason, in accordance with the Consumer Contracts Regulations 2013. To exercise this right, you must inform us in writing at contact@thejacketseller.com before the cancellation period expires.
As explained in clause 10, this statutory 14-day right does not apply to Made-to-Order or personalised Products, in accordance with Regulation 28(1)(b) of the Consumer Contracts Regulations 2013. Made-to-Order Products are instead governed by our Return & Refund Policy and clause 15 below.
14. Order Cancellation by You After Production Begins
Because Products are manufactured to order, cancelling an Order after production has started incurs costs already committed on your behalf (materials, labour and production scheduling). Our cancellation charges are as follows:

Cancellation requests must be sent to contact@thejacketseller.com. This clause operates alongside, and does not remove, any statutory right you may separately have under clause 16 in respect of faulty or mis-described goods.
15. Returns, Refunds and Exchanges
Returns, refunds and exchanges (including for sizing issues on Made-to-Order Products) are handled in accordance with our published Return & Refund Policy, available at Link, which forms part of these Terms. That policy sets out, among other things, applicable time limits, evidence requirements (such as photographs), the RMA process, and the applicable refund/exchange percentages for different scenarios.
Return shipping costs are payable by you unless the return relates to a fault, defect, or an error on our part, in which case clause 16 applies.
16. Faulty, Damaged or Mis-Described Goods (Consumer Rights Act 2015)
Nothing in these Terms affects your statutory rights as a Consumer under the Consumer Rights Act 2015. Under that Act, Products must be:
- of satisfactory quality;
- fit for purpose; and
- as described.
If a Product is faulty, damaged in transit, or does not match its description (including where it does not match confirmed measurements as described in clause 10), you may be entitled to a repair, replacement, price reduction, or refund, depending on how long you have had the Product and the circumstances, in accordance with the Consumer Rights Act 2015. To make a claim, contact us at contact@thejacketseller.com with your Order number and clear photographs of the issue, and we will guide you through the applicable process under our Return & Refund Policy.
17. Chargebacks and Payment Disputes
If you have a concern about your Order, we ask that you contact us directly at contact@thejacketseller.com before initiating a chargeback or payment dispute with your bank or card issuer, so that we have a fair opportunity to resolve the matter. Initiating a chargeback without first attempting to resolve the issue with us may delay resolution and does not remove your obligations under a Contract validly formed under clause 8. We reserve the right to dispute chargebacks we believe are unwarranted by providing evidence of the Contract, delivery and communications to the relevant payment provider.
18. Acceptable Use of the Website
You agree not to:
- use the Website for any unlawful purpose or in a way that breaches any applicable law;
- attempt to gain unauthorised access to the Website, our servers, or any account other than your own;
- introduce viruses, malware, or other harmful code;
- use automated systems (bots, scrapers) to extract data from the Website without our written consent;
- interfere with or disrupt the operation of the Website or the networks connected to it.
We reserve the right to restrict or terminate your access to the Website for breach of this clause.
19. User-Generated Content and Reviews
If you submit reviews, photographs, or other content to the Website ("User Content"), you confirm that you own or have the necessary rights to that content and that it does not infringe any third party's rights or applicable law. You grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that User Content in connection with operating and promoting the Website and our Products.
We may remove any User Content at our discretion, including content that is unlawful, offensive, or in breach of these Terms.
20. Intellectual Property
Our content. The Website's layout, design, original written content, and our own branding and logos are owned by or licensed to The Jacket Seller Ltd.
Product imagery. Product images displayed on the Website may be supplied by our manufacturing and sourcing partners for the purpose of illustrating the Products offered for sale. Where such images are provided by third parties, those third parties remain responsible for ensuring they hold the necessary rights to supply and authorise the use of such imagery.
Rights holder complaints. If you are a rights holder and believe that content on this Website infringes your intellectual property rights, please contact us immediately at contact@thejacketseller.com with details of the material and your claim of ownership. We will investigate promptly and remove or replace any content found to be used without appropriate authorisation.
22. Privacy and Data Protection
We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and our Privacy Policy, available at Link. By using the Website and placing an Order, you acknowledge that your personal data will be processed as described in that policy, including for order fulfilment, customer service, fraud prevention, and (where you have consented) marketing communications.
23. Cookies
The Website uses cookies and similar technologies to operate correctly, analyse usage, and (subject to your consent) support marketing. Details of the cookies we use and how to manage your preferences are set out in our Cookie Policy / Privacy Policy.
24. Disclaimers
We make reasonable efforts to keep the Website accurate, secure and available, but we do not guarantee that it will be uninterrupted, timely, or error-free. The Website is provided "as is" and "as available" save for any warranties which cannot lawfully be excluded, including your statutory rights under the Consumer Rights Act 2015.
25. Limitation of Liability
Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability which cannot lawfully be excluded or limited under English law.
Subject to the above, and to the maximum extent permitted by law:
- our total liability to you arising out of or in connection with a Contract, whether in contract, tort (including negligence) or otherwise, is limited to the total price paid by you for the relevant Order;
- we are not liable for any indirect or consequential loss, or for any loss of profit, business, revenue, or anticipated savings, in each case whether or not such loss was foreseeable.
This clause does not affect your statutory rights as a Consumer.
26. Indemnity
You agree to indemnify and hold us harmless from any claims, losses, liabilities and reasonable expenses (including legal fees) arising out of your breach of these Terms or your misuse of the Website, except to the extent caused by our own breach or negligence.
27. Force Majeure
We will not be liable for any failure or delay in performing our obligations under a Contract where that failure or delay results from events outside our reasonable control, including but not limited to strikes, natural disasters, extreme weather, war, civil unrest, courier or customs delays, pandemic-related restrictions, or failure of suppliers or subcontractors. If such an event continues for more than 30 days, either party may cancel the affected Order, and any payments made will be refunded in accordance with our Return & Refund Policy.
28. Complaints and Alternative Dispute Resolution
If you have a complaint, please contact us first at contact@thejacketseller.com so we can attempt to resolve it directly. If we are unable to resolve a dispute to your satisfaction, you may be entitled to refer the matter to an approved Alternative Dispute Resolution (ADR) provider. We will confirm at that time whether we agree to participate in ADR, in accordance with the Alternative Dispute Resolution for Consumer Disputes (Amendment) Regulations. This clause does not affect your right to bring a claim through the UK courts, including via the small claims track for lower-value disputes.
29. General Provisions
29.1 Entire Agreement
These Terms, together with our Return & Refund Policy, Shipping Policy and Privacy Policy, constitute the entire agreement between you and us regarding your use of the Website and any Order, and supersede any prior agreements or understandings.
29.2 Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect.
29.3 Waiver
Our failure to enforce any provision of these Terms at any time does not constitute a waiver of our right to enforce that or any other provision later.
29.4 Assignment
We may assign, transfer or subcontract our rights and obligations under a Contract to a third party without affecting your statutory rights. You may not assign or transfer your rights or obligations under a Contract without our prior written consent.
29.5 No Third-Party Rights
A Contract is between you and us. No other person has any right to enforce any of its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
30. Governing Law and Jurisdiction
These Terms and any Contract formed under them, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms, save that if you are a Consumer resident elsewhere in the UK, mandatory local consumer protection law of your place of residence may also apply and you may bring proceedings in your local courts.
